What is a short sale?

A short sale happens when your mortgage lender agrees to accept less than the full amount you owe, so the home can be sold to a new buyer. The lender approves the sale, and the difference between what you owe and what the home actually sells for is the shortfall.

It is a negotiation between you, your lender, and a buyer, and it is a real estate transaction like any other, which means a skilled local agent matters. I have negotiated short sales across North Jersey for over 15 years, and I know which lenders move fast, which ones stall, and how to keep a file alive through approval.

When It Makes Sense

When does a short sale actually make sense?

You owe more than the home is worth, and your payment is more than you can handle.

You are going through a true hardship: job loss, divorce, medical bills, a business setback, or a death in the family.

You want to leave the mortgage behind on better terms than a foreclosure would give you.

You are ready to move on, and you want a real plan instead of waiting for the bank to act first.

Lenders will almost always ask for proof of hardship before they approve a short sale, so honesty about your situation is not just the right thing, it is part of the deal. If you cannot document a hardship, a short sale probably is not available to you, and we will talk about what is.


The Truth

Will a short sale hurt your credit?

Yes, it will, and anyone who promises otherwise is not being straight with you. Here is what is true:

  • A short sale and a foreclosure are both serious credit events. Both can stay on your credit report for seven years from the first missed payment.

  • A short sale is generally easier on your credit than a foreclosure. The score drop is commonly smaller, and the road back to homeownership is shorter: for example, FHA financing is typically available two years after a short sale, versus three years after a foreclosure.

  • The part most people do not know: New Jersey is a recourse state. Your lender can still pursue you for the unpaid balance after a short sale, unless the lender agrees in writing to waive that deficiency. Getting that waiver in writing before you close is one of the most important pieces of the entire deal.


New Jersey Specifics

How New Jersey makes short sales different

New Jersey is a judicial foreclosure state

Your lender cannot simply take the home. It must file a lawsuit in Superior Court, Chancery Division, and a judge has to enter a foreclosure judgment before a sheriff's sale can happen. That process takes time, and time is leverage when you are negotiating a short sale.

The Fair Foreclosure Act gives you notice

Before your lender can file, it must send a Notice of Intention to Foreclose at least 30 days ahead. That window is often the best time to act, while you still have room to negotiate rather than react.

Deficiency judgments have a deadline

In New Jersey, a lender that wants a deficiency judgment after a foreclosure sale generally has to file a separate action within three months of the sale or its confirmation under N.J.S.A. 2A:50-2, and the amount can be disputed based on the property's fair market value. Once again, the cleanest protection for you is a written waiver as part of a short sale approval.

Foreclosure mediation is available

New Jersey's court-sponsored Foreclosure Mediation Program lets homeowners facing foreclosure meet with their lender in front of a neutral mediator to explore alternatives like a loan modification. Eligible homeowners who own and occupy their 1 to 3 family home generally apply within 60 days of being served. A consultation with Johnny can help you figure out whether it applies to you.
